The UPC Agreement is currently expected to enter into force on 1 April 2023.


It has been a lengthy and complex road to get to this point, but the last piece of the jigsaw is now for Germany to formally “deposit” its ratification of the relevant legal agreements with the EU.

This final step has been held back until practical preparations can be made for the new court system to be operational (such as hiring judges and sorting out IT systems).

Now it is expected that the deposit will take place in December 2022, so that the UPC can start operating from 1 April 2023 onwards.

Before that date, there are various transitional arrangements for the Unitary Patent to provide early access to the system, and a sunrise period for the Unified Patent Court to enable opt outs to be filed.
